1. Introduction

By booking a safari or any travel experience with Wecam Tours & Safaris, based in Nairobi, Kenya, you agree to be bound by the following terms and conditions. These terms are designed to ensure clarity, fairness, and safety for all parties. Please read them carefully before confirming your trip.

2. Booking and Confirmation

Your booking becomes valid once we receive either the full payment or a deposit as indicated in your invoice, and we confirm your reservation in writing. The remaining balance must be paid by the date specified in your travel documentation. It is your responsibility to provide accurate personal information, including passport details, health requirements, and visa eligibility where applicable.

3. Transfer of Bookings

You may transfer your booking to another individual if you notify Wecam Tours & Safaris no later than seven days before the departure date. The new traveler must meet all required conditions for the trip, including valid travel documents, visa, and health requirements. Any costs incurred during the transfer process, including airline fees and administrative charges, will be your responsibility. Both the original traveler and the new one remain jointly responsible for the total payment of the trip.

4. Price Adjustments

Prices quoted at the time of booking may be revised under specific circumstances. These include changes in transportation costs, including fuel surcharges, newly imposed or increased government taxes, park fees, or airport charges, as well as significant shifts in currency exchange rates. Any price increase will be communicated at least twenty days prior to your departure and will not exceed ten percent of the total tour cost. If the increase surpasses ten percent, you may choose to cancel your booking and receive a full refund.

5. Changes Requested by the Traveler

If you wish to make changes to your confirmed booking, you must contact us as soon as possible. While we will do our best to accommodate reasonable requests, any alterations may be considered a cancellation of the original booking and subject to rebooking terms. All costs resulting from such changes, including differences in pricing and service fees, will be borne by you.

6. Changes Made by Wecam Tours & Safaris

On occasion, Wecam Tours & Safaris may need to make changes to itineraries due to unforeseen circumstances such as hotel availability, park regulations, natural events, or operational requirements. When changes occur, we will substitute comparable or superior alternatives. In the rare event of a significant alteration or cancellation by us, you will have the option to cancel your booking for a full refund or choose an alternative tour. If the replacement tour is more expensive, you will be responsible for the price difference. If it is cheaper, you will be refunded the balance.

7. Cancellation Policy

Unless otherwise stated in your individual booking documents, the following cancellation terms apply. Upon cancellation after the initial deposit, the deposit is non-refundable. If the cancellation occurs between 100 and 60 days before departure, seventy percent of the total tour cost is forfeited. Cancellations made less than 59 days before departure are non-refundable.

8. Force Majeure Cancellations

You have the right to cancel your trip and receive a full refund if the travel destination is declared unsafe due to war, natural disasters, epidemics, or if government advisories advise against travel within fourteen days of departure. This condition applies only when such travel restrictions are issued by official government or international bodies.

9. Complaints During the Tour

If any issue arises during your safari, you are expected to report it immediately to your guide or our local representative. If the issue is not resolved to your satisfaction, you must contact our head office in Nairobi directly. Failure to raise the concern promptly during the trip may affect your right to claim compensation afterward.

10. Complaints After the Tour

Complaints following the completion of your safari must be submitted in writing within fourteen days after your tour ends. Complaints received after this period may not be considered unless exceptional circumstances exist that prevented earlier communication.

11. Travel Insurance

It is highly recommended that you take out comprehensive travel insurance that covers trip cancellation, medical emergencies, evacuation, lost or stolen belongings, and other unexpected occurrences. Wecam Tours & Safaris is not liable for any personal loss or costs arising from lack of appropriate insurance.

12. Limitations of Liability

Wecam Tours & Safaris is not responsible for any damages, injuries, or losses incurred as a result of services provided by third-party operators such as airlines, hotels, or transport providers. Additionally, we are not liable for disruptions caused by events beyond our control, including natural disasters, road closures, government actions, wildlife activity, or weather conditions. Our liability is limited in accordance with the relevant international conventions and applies only to services directly arranged by us.

13. Passports, Visas, and Health Requirements

You are solely responsible for ensuring that your travel documents, including passport, visa, and health certificates, are valid for the duration of your trip. While we can offer guidance, the final responsibility lies with you.

14. Legal Jurisdiction

These Terms and Conditions are governed by the laws of Kenya. Any disputes arising from your engagement with Wecam Tours & Safaris will be resolved in Kenyan courts unless otherwise agreed by both parties.
